Vaccine Injuries

When you vaccinate yourself or your family, the goal is to prevent illness.  Thankfully adverse reactions or injuries from vaccines are relatively rare.  When they occur, however, the consequences may be devastating leading to serious injury or even death.  Your healthcare provider may administer the incorrect vaccine or may fail to properly identify or treat an allergic reaction or illness resulting from the vaccination.  In the worst cases, the vaccine itself may be defective which leads to injury.

If you or someone you love has been injured due to a vaccine or a mistake in the vaccination process, Cooper Sevillano can help.  We will investigate the cause of your injury and explore all avenues of recovery including against the physician, medical practitioner, pharmacist or pharmaceutical company. Our attorneys have handled numerous medical malpractice claims and have spent years building relationships with trial experts that ensure we can present the most effective case to a jury.

In addition, you may have the right to compensation under the National Vaccine Injury Compensation Program (VICP), a no fault alternative to a traditional liability suit brought in the United States Court of Federal Claims.  To be eligible for compensation under VICP, you must meet certain criteria.  The vaccine must have resulted in an injury which lasted for more than six months, resulted in a hospital stay and surgery, or resulted in death.  In addition, only certain vaccines are covered including:

•Diphtheria, tetanus, pertussis (DTP, DTaP, Tdap, DT, Td, or TT)

•Haemophilus influenzae type b (Hib)

•Hepatitis A (HAV)

•Hepatitis B (HBV)

•Human papillomavirus (HPV)

•Influenza (TIV, LAIV)

•Measles, mumps, rubella (MMR, MR, M, R)

•Meningococcal (MCV4, MPSV4)

•Polio (OPV or IPV)

•Pneumococcal conjugate (PCV)

•Rotavirus (RV)

•Varicella (VZV)

Whether you have are filing a traditional liability suit or would like to seek compensation under VICP, we at Cooper Sevillano can assist you with the claim process.
